Filing Chapter 13 Bankruptcy in Massachusetts

One of the ways to get out from under overwhelming debts, is by filing for Chapter 13 bankruptcy. The majority of our Chapter 13 bankruptcy clients are carrying debt from $20,000 - $50,000 or more. They are individuals, married couples and families from all walks of life who have assets to protect. Without question, they experience relief once they have a roadmap to financial stability to follow.

To determine whether Chapter 13 bankruptcy is right for your, you should arrange a free initial consultation at one of our offices in Worcester, Springfield, Framingham, South Easton or Sturbridge. An experienced lawyer will sit down with you and listen to your concerns, answer your questions and give you a general assessment of whether bankruptcy is a good solution for your financial challenges.

What Is Chapter 13 Bankruptcy?

Unlike a Chapter 7, which offers a discharge (elimination) of most unsecured debt, a Chapter 13 bankruptcy legally reorganizes your debt and requires you to pay some of the debt back over the course of a three to five year repayment plan. Your assets such as your home and car can be protected and arrears up to four months can be folded into the payment plan.

As your bankruptcy attorneys, we strive to create a debt repayment plan that keeps your unsecured debt payments as low as possible while protecting you against mortgage foreclosure, car repossession and wage garnishment.

Before you can enjoy the benefits of a Chapter 13 bankruptcy, a bankruptcy plan must be approved by a bankruptcy trustee. After the court and your creditors approve your bankruptcy, you pay one lump sum a month to this federally mandated bankruptcy trustee, who will distribute the payment to your creditors.

There are many benefits associated with filing for a Chapter 13 bankruptcy, including:

  • Stop foreclosure actions
  • Provide debt relief for high-income individuals and families who do not qualify for Chapter 7 bankruptcy
  • End creditor harassment (all calls are routed through your lawyer)
  • Put financial control of your life back in your hands
