There are no hard-and-fast rules regarding discharging tax debts in bankruptcy, as such a discharge is truly uniquely based on the person or couple in question. However, we can tell you the following:
- Tax debt is not dischargeable if it is less than three years old from the date of your assessment
- An additional legal proceeding will be required to discharge your debts through your bankruptcy proceeding
